1. Quotations & Acceptance
1.1 All quotations are issued following a site visit or assessment of the Client’s requirements.
1.2 Quotations will detail the scope of work, materials, cost, and estimated timeframe for landscaping, driveway, paving, fencing, decking, drainage, or hard landscaping works.
1.3 Quotations remain valid for 14 days unless otherwise stated.
1.4 Acceptance of the quotation (by email, message, or written confirmation) forms a legally binding agreement between Elite Landscaping Ltd and the Client.
2. Scope of Work
2.1 All works will be carried out strictly in accordance with the agreed quotation.
2.2 Any request for additional work, including changes to materials (e.g., upgrading to porcelain paving, resin bound finish, composite decking, electric gates, or additional drainage), shall constitute a variation.
2.3 Variations will:
- Require written approval.
- Be subject to additional charges.
- Be invoiced separately where necessary.
2.4 No additional work will commence without Client approval.
3. No Deposit Policy
3.1 Elite Landscaping Ltd operates a strict No Deposit Policy across London and Croydon.
3.2 No upfront payment is required before the commencement of works.
3.3 Payment is only required once the agreed driveway, paving, fencing, decking, turfing, or landscaping works are completed to your satisfaction.
4. Payment Terms
4.1 Full payment is due within 24 hours of satisfactory completion of the agreed works.
4.2 An invoice will be issued upon completion.
4.3 Payment must be made via bank transfer or another agreed payment method.
4.4 Failure to make payment within 24 hours may result in recovery action and interest charges in accordance with UK legislation.
5. Client Inspection & Satisfaction
5.1 Upon completion, the Client must inspect the finished works, including resin driveways, block paving, porcelain patios, fencing, decking, drainage systems, or hard landscaping installations.
5.2 Payment is not required until the Client confirms satisfaction within the agreed scope of work.
5.3 Minor aesthetic variations in natural stone, porcelain slabs, timber, resin aggregate, or Indian sandstone are an inherent characteristic and are not considered defects.
5.4 Additional requests outside the agreed quotation do not constitute grounds for withholding payment.
6. Materials & Ownership
6.1 All materials supplied, including Type 1 sub-base, concrete, resin, porcelain slabs, Indian sandstone, fencing panels, gates, decking boards, artificial grass, and drainage components remain the property of Elite Landscaping Ltd until full payment has been received.
6.2 Natural materials may vary in shade, texture, and finish. This is an inherent characteristic and not a defect.
7. Ground Conditions & Drainage
7.1 Landscaping and driveway installations depend on suitable ground conditions.
7.2 If unforeseen issues arise (e.g., unstable ground, hidden utilities, drainage complications), additional work may be required.
7.3 Any additional drainage systems, French drainage, ground stabilisation, or excavation works will be discussed and agreed upon with the Client before proceeding.
8. Project Timelines
8.1 Timeframes provided are estimates only.
8.2 Delays may occur due to severe weather conditions, supplier delays, concrete curing periods, restricted site access, or underground obstructions. Elite Landscaping Ltd shall not be held responsible for delays beyond its reasonable control.
9. Concrete & Sub-Base Installation
9.1 Where concrete or Type 1 sub-base is installed for driveways, patios, steps, or garden walls, appropriate curing periods must be respected.
9.2 Damage caused by premature use before the advised curing time will not be covered under warranty.
10. Warranty
10.1 We provide a comprehensive 10-Year Installation Warranty covering defects in workmanship under normal residential use.
10.2 The warranty does not cover:
- Lack of maintenance
- Structural ground movement
- Third-party damage
- Misuse or negligence
- Normal wear and tear
11. Insurance & Liability
11.1 Elite Landscaping Ltd maintains comprehensive Public Liability Insurance.
11.2 We are not responsible for pre-existing structural issues, undisclosed underground services, damage caused by third parties after completion, or movement caused by natural ground settlement.
11.3 Total liability shall not exceed the total contract value.
12. Waste Removal
12.1 Waste removal and site clearance are included only where specified in the quotation.
12.2 Additional waste not included in the original scope may incur extra charges.
13. Termination
13.1 Either party may terminate the agreement with written notice.
13.2 The Client remains responsible for payment of all completed works up to the termination date.
14. Governing Law
14.1 These Terms and Conditions are governed by the laws of England and Wales.
